DOMESTIC VIOLENCE VICTIM COMPENSATION AND BENEFITS IN NEW YORK
Crime victims compensation programs in New York and throughout the United States provide important and needed help and financial assistance to victims of crime.
As a result of being a victim of domestic violence, the crime victim will have most likely have to bear the burden of the financial costs associated with the domestic violence in addition to recovering from the physical injuries and overcoming post traumatic stress.
The good news is that help is available!
Being a victim of violence or abuse places a tremendous amount of the stress on the victims and their families. They should not have to be concerned with worrying about paying the bills associated with their medical services, counseling services, lost income or funeral and burial expenses where a loved one has died as a result of being a victim.
Luckily, each state has a crime victim compensation program and a number of them receive funds under the Victim of Crime Act (VOCA) that allows them to offer financial help to domestic violence victims and their families.
In addition to the government funds, the crime victims compensation fund in most states obtain this money almost exclusively from the penalties, fees and fines assessed the perpetrators and criminals who were found guilty of the crime. This provides the states with the resources to also fund programs that provide crime victim assistance and services in your area.
In New York State, a victim of domestic violence can apply to receive money from the crime victims' compensation fund by filing an application with the NYS Office of Victim Services (OVS), formerly referred to as the NY Crime Victims Board (CVB).

DOMESTIC VIOLENCE VICTIM HELP AND ASSISTANCE IN NEW YORK
You should know, while the victim of crime compensation programs for all states are different and are administered under each state's own laws, the application process can be sometimes be lengthily and requiring extensive follow up by the domestic violence victim or claimant. This is why it can be extremely beneficial to work with a domestic violence victim advocate or domestic violence victim attorney who specializes in criminal injury compensation and who can advise you of your domestic violence victim's rights.
However, all states have similar basic requirements to assess eligibility for financial help and assistance for the victim. In general, a victim is required to do the following:
- Timely notify and file a report with the police, troopers, sheriff or child protective services, family court or other criminal justice authority or agency responsible for the enforcement of the law
- Cooperate with law enforcement, the district attorney (DA) and prosecutors in the investigation and prosecution of the claim
- Submit and file a crime victim compensation application within the allowed time period (exceptions may apply)
- Have an un-reimbursed expense or loss not being paid for by insurance or another government benefit program (crime victim compensation assistance programs are payers of last resort)
- That you are not responsible for are engaging in some improper act that contributed to the crime
- The location, arrest or conviction of the criminal or perpetrator is not a requirement (a prime example is being injured as a result of being a victim of hit and run.)
